COMPLETION OF Vendor REGISTRATION AND

ACCEPTANCE

 

1. As a part of the registration process, You state that You have completed the Seller Registration

Form and provided other relevant details as required by P Mart. You represent that You, in your individual capacity and/or as an authorized representative of the entity registering as a Seller ontheWebsite, are competent to contract, are at least eighteen (18) years of age, are of sound mind and are not disqualified from entering into a lawful contract under ApplicableLaws.

 

2.2 You have the option of accepting or declining to accept this Agreement. Please provide Your Acceptance to this Agreement if and only if you are agreeable to the terms and conditions provided herein. Upon Your Acceptance, this Agreement shall become binding on You. Without prejudice to the binding nature of this Agreement upon Your Acceptance, P Mart may, as an additional

Electronic record of this Agreement, send an “Agreement Acceptance Notification” in electronic form, along with an electronic copy of this Agreement in PDF or any other readable and storable format to the email address provided by You in the Seller Registration Form.

 

3.If You are not agreeable to the terms and conditions of this Agreement, please DO NOT accept this Agreement and do not use the Website for the purpose of exhibiting, advertising,making available or offer for sale of the Products. This will stop the Seller registration process.

 

4. You will be solely responsible for maintaining the safety and confidentiality of Your log-in, password and details in relation to the Seller Panel and the information provided therein, and shall be fully responsible for all activities that occur under Your Seller Panel. You agree to (a)immediately notify P Mart (to the Grievance Officer) of any unauthorized use of Your account information or any other breach of security, and (b) ensure that You exit from Your Seller Panel account at the end of each session. P Mart shall not be liable for any loss or damage arising from Your failure to keep Your Seller Panel protected from any unauthorized access, blockage, misuse or any other unauthorized use and You shall indemnify P Mart in accordance with this Agreement for any such unauthorized use.

5. P Mart reserves the right to suspend or terminate access to Sellers registered on the Website and the Seller Panel, at any time and without assigning any reasons for doing so.

LISTING, SALE AND DELIVERY OF THE PRODUCT

 

1. By exhibiting, advertising or listing any Product on the Website, You agree that You are making an „offer to sell? Your Product to the users of the Website and such offer, upon acceptance by a user, shall be binding on You. The sale,purchase, return, delivery and other terms of sale shall be further subject to the Standard Terms of Sale on the Website.

 

2.You shall provide true, complete and correct brand name (if any), identification (if any), information, images, description and MRP, Selling Price of the Product on the Website for thepurpose of the Product?s exhibition, advertising, making available or offer for sale in the appropriate category, which may include an informative description of each Product (including but not limited to the length, breadth and height of the Product) and its contents, by way of text descriptions, graphics, or pictures or videos. You hereby permit, and hereby grant all the

Rights and licenses to P Mart on worldwide basis to permit, other sellers on the

Website to use Your aforesaid information and materials for advertising, exhibiting, making available and offering to sell such other sellers products on the Website. Unless mandated under any Applicable Law, Your aforesaid information and materials shall not be disabled or deleted from the Website till such time any seller on the Website is using the same for advertising, exhibiting, making available and offering to sell such other sellers products on the Website.

 

3.You represent and warranty that the Product description shall not be misleading and shall describe the actual condition of the Product. If a Product is subject to expiry date or expiry duration, You shall not offer to sell and sell any such Product which has passed 75% (seventy five percent) of its expiry duration. If the Product sold does not match the Product description displayed on the Website,

You shall refund and permit P Mart to refund any amounts that You may have received, or have credit to You, from the Buyer. You represent that you have obtained all Consents as may be required in order to provide the information and description of the Products on the Website.

 

4.You shall be solely responsible for ensuring that the Seller Panel is updated and reflects the real-time availability / non-availability of the Products listed on the Website. You shall be responsible for claims made by Buyers for inaccurate Product availability details that are displayed on the Website due to any

negligence / default on Your part to provide updated and accurate Product information. You shall retain adequate inventory of the Products listed on the Website for successful and timely fulfillment of orders.

 

5.You may also be required to provide images of the Products and/or images of the brands/ logos of the Products. You grant P Mart a non-exclusive and worldwide right and license to use the Product description, images of the brands/ logos of the Products to be used on the Website, and in any marketing and promotion material of P Mart to promote the sale of such Product on the Website, and, if required, to make technical modifications to the images so as to render them feasible for uploading on the Website. You represent that you have obtained all Consents as may be required (including Consents from the owners of the relevant brands where relevant) in order to grant P Mart the aforesaid rights and licenses.

 

6. You shall not attempt to exhibit, advertise, make available or offer for sell or use any Logistics Services provided by P Mart for any Products falling in the category of P Mart Banned Products? List on this Website. P Mart shall be entitled to block or disable access of all such products and shall also have the right to suspend or terminate the Seller?s access to the Seller Panel and the Website or

terminate this Agreement forthwith. You agree and acknowledge that P Mart is not under any obligation or duty to verify or monitor any listing or content You provide or make available on the Website. You shall be the originator of all such listings or content and all the data and information contained therein,and P Mart shall be an intermediary for the purpose of such listings or content and

all the data and information contained therein.

 

7.On the Buyer selecting to purchase the Products (i.e. “ordering”) exhibited, advertised, made available or offered to sell by You on the Website and either making the payment of the Selling Price through the payment gateway provided on the Website or opting for cash on delivery, You will be intimated of the same through an electronic notification on the Seller Panel along with the details of the Buyer as provided by Buyer on the Website. You shall forthwith ensure that the Product(s) so ordered as duly and safely packed in accordance with Applicable Laws and shall immediately fulfill and complete the order of the Buyer.

 

8.You shall ensure that the Product as ordered by the Buyer is dispatched to the Buyer within such time period which P Mart may prescribe from time to time, along with all the required information,manuals, accessories (where applicable) warranty documents (where applicable) and any other relevant documents, to enable the Buyer to optimally use the Product purchased. You shall also issue and

send a corresponding Invoice along with the Product.

 

9. You will have various Delivery Models for delivery of purchased Products to the Buyers. P Mart may, at its discretion, remove on or more Delivery Models or introduce other Delivery Models at any time in the future. On introduction of such other delivery models, P Mart may, at its discretion, offer these delivery options to all or select Sellers. The default delivery model will be Dropship model

for the delivery of the Product. You agree that, when You elect to deliver Your Products through the Delivery Models provided by P Mart, the Products shall considered to be delivered when actually delivered to the Buyer. The risk of any damage, loss or deterioration of the Products during the course or delivery or during transit shall be on the Seller and not on P Mart, its third parties or on the

Buyer. You represent and warrant that the Products being delivered under the Delivery Models not faulty and are exactly those Products which are listed and advertised by You on the Website and purchased by the Buyer and meet all descriptions and specifications as provided on the Website.

 

10.You agree and acknowledge that exhibiting, advertising, making available or offering for sale, using Logistics Services, actual sale of and delivering illegal,infringing, fake, duplicate, spurious, counterfeit, refurbished, Selling expired FMCG products or previously owned Products or Products meant “not for sale” through the Website is prohibited and inter alia will cause great prejudice and harm to the reputation and goodwill of P Mart, and may also cause harm and prejudice to the Buyers and You shall not engage or attempt to engage in such activities. Further, if P Mart receives any complaint from any Buyer, or any third party or if You are found exhibiting, advertising, making available or

offering for sale, using Logistics Services, selling or delivering illegal, infringing, fake, duplicate, spurious, counterfeit, refurbished or previously owned Products or Products meant “not for sale”

or attempting to undertake the above through the Website, then, without prejudice to P Mart?s other rights and remedies, You shall be liable to pay such amount to P Mart in accordance with “Product

Return Policy” and “Prohibited Seller Activities and Consequences Policy”

.

You agree that this liability will not be treated as penalty and P Mart shall have all other legal rights and remedies under this Agreement and Applicable Laws. P Mart reserves the right to adjust or off set the above amount from any amount accrued or due to You or is required to be remitted to You pursuant to this Agreement.

 

11.P Mart reserves the right to demand any document related to Products listed by You including

documents required for the verification of Product genuineness.

 

12.You shall not submit any incorrect, incomplete, misleading or fake documents like invoices, brand authorisation certificate or any other document called for by P Mart, or re-register with another name in the event of getting delisting from the Website.

13.You hereby agree and acknowledge that any Product sold by You to Buyer may be refused to be accepted or taken delivery by the Buyer. You agree to accept the return of such Products whether

ordered on cash on delivery mode or any other mode of payment. In case of rejection or non-acceptance of the Product by the Buyer, P Mart shall refund to the Buyer the Selling Price paid by the Buyer and Seller shall be liable to pay the charges in accordance with Commercial Term Segment.

 

14.In case of return or rejection of Products or Products getting damaged during the handling or warehousing of them and where P Mart is liable or otherwise agree to pay You the cost or Selling Price of such Products as per the Trust Pay Policy or any other policy for the time being, then You agree and permit that P Mart or any liquidator/ auctioneer appointed by P Mart may, either itself or through any third party, liquidate/sell or repair/recondition/refurbish those Products to recover the losses

Incurredor payments made to You.If P Mart has recovered the loss or payments made to You herein from the Logistic Service Provider or any third party under the respective service arrangement, then You permit such Logistic Service Provider or third party to liquidate/sell such Products to recover their

losses or payments made to P Mart. Without prejudice to all our rights and available remedies for Your fault or breach under this Agreement, You relinquish Your rights with respect to the Products liquidated pursuant to this clause.Further, You agree to ensure compliance of Applicable Laws including tax matters & movement documentation with respect to such returned or rejected Products till those Products are brought into the liquidation place. You agree and permit P Mart, its third parties or Logistics Service Provider to transfer the title in the Products and other collateral and benefits thereto (viz., warranties etc.) in the same manner as You would have transferred to the Buyer. P Mart states that any such sale or liquidation by P Mart shall be on wholesale basis or business-to-business basis.

 

15.For the purpose of marketing or promoting the Website and other services, P Mart may run various promotional offers from time to time to the Buyers or otherwise on the Website or in relation to the Website.

 

16.All commercial / contractual terms such as selling price of the Product, dispatch, delivery of the Products, warranties, etc., are bipartite contracts between the Buyer and You. P Mart and/or the Website are in the role of intermediaries in all such transactions. The payment facility is merely used by the Buyer and You to facilitate completion of the transaction. Use of the electronic payment facility

or the cash on delivery method shall not render P Mart liable or responsible for the non-delivery of the Products listed on the Website or for any other reason whatsoever.


 

Drop Ship Policy: Code of Conduct


 

Fulfilment by Seller: (End to End Delivery, Installation and Returns)

  1. Seller shall be solely responsible for packaging, delivery, installation, re-packaging, uninstallation and reverse logistics of products under this dropship model either directly by the seller or through a third party appointed by the seller.

  2. Parties hereby agree that P Mart shall not be responsible for any loss, damage, costs or liabilities that may arise as a consequence of the delivery, installation, packaging, re-packaging, uninstallation, reverse logistics or any post-sale service provided by the seller to the buyer. Seller agrees to indemnify P Mart against any damage suffered by P Mart as a consequence of any breach or claims on P Mart with respect to such services provided by the seller.

  3. Seller agrees to observe the instructions and guidelines determined by P Mart with respect to shipment and regularly update the status of shipment against every order on the seller dashboard. The status may be updated as ‘dispatched’, ‘delivered’, ‘installed’ etc. (as appropriate).

  4. P Mart reserves the right, at its sole discretion, to change, modify, add, or remove portions of this policy at any time and without any prior written notice to the Seller. It is the responsibility of the Seller to review this policy periodically for updates/changes. 

Delivery

  1. Seller shall be responsible for end-to-end delivery of the product till the location specified by the buyer.

  2. Seller shall deliver the products to the buyer within the committed timelines.

  3. A request for early or late delivery by the buyer will be entertained at the sole discretion of the seller on a case to case basis. However, sellers are required to hold the product for a minimum of 5 days from the committed delivery SLA to account for any schedule changes. P Mart will be in no way responsible for the costs incurred due to change in the delivery SLA.

  4. A request for early or late delivery by the seller will be entertained at the sole discretion of the buyer on a case to case basis.

  5. Seller shall be penalized for breach in the following cases:

    1. In case of a delivery breach by the seller: Delivery breach occurs when seller does not deliver the product within promised SLA unless with the consent of buyer;

If delivery breach rate > 1.5%, seller will be made pending for a week or will be blacklisted.

Delivery breach rate = Total number of ordered units that breached delivery SLA by date/Total number of units ordered

    1. If the seller cancels the order at any stage, a penalty of 5% of the value of product will be charged;

  1. Seller shall update the tracking ID for each shipment on the seller panel for delivery either directly or through a third party logistics service provider. 

Installation

  1. Seller shall be responsible for installation of the product at buyer’s location.

  2. Seller shall be penalized for breach in the following cases:

  1. In case of installation breach by the seller: Installation breach occurs when seller does not complete the installation within SLA unless with consent of buyer.

If Installation breach rate > 1.5%, seller will be made pending for a week or will be blacklisted

Installation breach rate will be calculated for a period of 2 weeks as follows:

Installation breach rate = Total number of ordered units that breached installation SLA by date/Total number of units ordered

Installation SLA for furniture category is 72 hours.

  1. In case of failure of the seller to install the products under 2 above ,warranty on the product will be valid even in cases where the installation is carried out by the buyer or any third party appointed by the buyer.

  2. On request of the buyer, seller shall extend the installation date up to a maximum of 7 days from the date of delivery of the product to the buyer. A request for installation after 7 days from the date of delivery shall be entertained at the sole discretion of the seller on a case to case basis. 

 

Reverse Logistics

  1. Seller shall be solely responsible for arranging the technician visit, uninstallation (if required), repackaging, pick up & reverse logistics of the product from buyer’s location in case of returns or replacement.

  2. Once a return or replacement request is raised by the buyer, seller shall arrange for a technician visit (wherever applicable) to buyer’s location within 3 days from the date of intimation.

  3. If the seller is unable to arrange for a technician visit (wherever applicable) within the agreed timeline, return request will be approved and processed by P Mart.

  4. Customer will be refunded the entire amount of the product in case of failure of the seller to arrange for reverse pick up within 10 days from the day customer raises a return request. 

 

Code of Conduct

Seller shall comply and ensure that its logistic partner complies (seller and its logistics partner hereinafter collectively referred to as the “Parties”) with the following Code of Conduct at all times. P Mart reserves the right to blacklist the seller or to make seller pending if found violating any of the below.

  1. Compliance with Applicable Laws and Anti-Bribery

Parties must comply with all applicable laws and regulations (“applicable laws and regulations”). P Mart has no tolerance for bribery or corruption in any aspect of its business. P Mart’s policy prohibits engaging in any form of corruption, bribery, kickback, extortion, embezzlement or money laundering. P Mart is committed not only to complying with all applicable laws and regulations regarding such activities but also to acting with integrity and the highest ethical standards. Parties shall not participate in, facilitate or permit any form of corruption, bribery, kickback, extortion, embezzlement or money laundering, whether with respect to public officials or to any other person. Parties shall comply strictly with all applicable laws and regulations and with P Mart’s policy set forth herein.

  1. No Discrimination or Harassment

Parties shall not discriminate in hiring or employment practices on the basis of race, national origin, gender, age, sexual orientation, citizenship, marital status, disability, veteran status or religion. Parties shall provide a workplace free from unlawful harassment. Parties shall comply with all applicable laws and regulations regarding employment, including but not limited to such laws and regulations related to minimum wage, maximum work hours, overtime and benefits. Contractors shall only employ individuals who are above the minimum working age as set forth in applicable laws and regulations.

  1. Safe Work Environment

Parties shall maintain a safe and sanitary workplace that includes appropriate protective equipment, and is in compliance with applicable environmental, health and safety laws, rules and regulations. P Mart recognizes the importance of our environment and natural resources, and advises the Parties to embrace the responsibility to society for prudently using natural resources and preventing harm to the environment. Parties shall comply with applicable environmental laws and regulations, including but not limited to obtaining required environmental permits, providing required environmental reports, properly controlling air, land and water emissions and properly disposing of chemicals and waste products.

  1. Intellectual Property

Parties shall respect the intellectual property rights of others and shall comply with applicable laws and regulations related to patents, copyrights, trademarks and trade secrets.

  1. Confidential and Proprietary Information

Parties shall safeguard P Mart’s confidential and proprietary information. This obligation includes using commercially reasonable means to safeguard information technology systems on which P Mart’s information is stored or transmitted. In addition, Parties shall refuse any improper access to confidential or proprietary information of any other company, including our competitors and customers.

Return Policy

1. Return / Replacement / Refund Policy

All products sold on P Mart should be brand new and 100% genuine. P Mart’s Return Policy covers the buyer against ‘damaged’, ‘mis-shipped’, ‘defective’ and ‘not as described’ products.

Buyers can raise a request for return, replacement/exchange or refund within the return guarantee period post order delivery which is as follows:

  • 10 days for categories other than fashion and books.

  • Jewellery, though under fashion, has a 10 day replacement policy. 

  • In case Value Added Services (“VAS”) sold by Sellers such as extended warranty or Damage protection plans which can be sold only along with the principal product, Buyer can raise a request for return or refund of VAS within the return guarantee period post order delivery which will be the same as the return guarantee period of the category of the principal product. Further, if a request for return or refund of the principal product is raised by the buyer, request for return or refund VAS shall be automatically raised and Seller shall have to honour the same.

 

**P Mart Advantage products sold by sellers have a 30 days Return Policy for all product categories.

Managing Buyer Returns:

P Mart offers a streamlined process for returns management for smooth flow of returns for both buyers and sellers. We will notify you through email in case a buyer requests return of a product. Buyer will state the reason for return (in some cases will also attach images). If buyer’s return does not fit the parameters specified on P Mart, returns can be rejected.

1.1. Return Request Raised

A buyer can raise a return request via P Mart buyer support (via Toll free no.) or directly using self-serve on the Website.

 You will receive an email notification when a return request is raised or a return is created by the buyer and you can view the same under all returns on the ‘Returns Dashboard’. On the Returns Dashboard, you will find the following return details:

  • Order summary

  • Status, quantity & price

  • Return request date and respond by date

  • Buyer details
     

1.2. Return Authorization and Troubleshooting

Starting 18th September 2014, return authorization will managed by P Mart for all kinds of return requests. This includes validation of return request and the approval of genuine return cases. P Mart will also provide specialized troubleshooting service for all marketplace sellers (at no extra cost) for the products in the following categories:

  • Consumer Electronics, Home & Kitchen Appliances, Personal & Health Care Appliances.

  • Precious Jewellery valued above INR 25,000/-

  • Mobiles and Tablets

  • IT products including Laptops, Computer Components and Peripherals


 

Accepted Return:

One of the following will be chosen while accepting a return from buyer:

  • Send buyer the new product and get old shipment back

  • Refund buyer and get old shipment back.

 

1.3.    Returns under Furniture and Sports & Fitness Category

Notwithstanding anything to the contrary contained herein, following are the terms and conditions that shall govern the buyer returns for products falling under Furniture and Sports & Fitness Category:

 

  • Buyer shall inform P Mart about defects/damages in the product within Ten (10) days of receipt of the product.

  • Once a buyer raises a return request and a return request is created by P Mart, seller shall arrange for a technician visit at the Buyer’s location for troubleshooting. If issue is not resolved after technician visit, part or full replacement will be initiated, as applicable.

  • If the buyer has received an item in a 'Damaged' or 'Defective' condition, or it is 'Not as Described' by the seller or in case of a wrong shipment or damage during installation, he/she can request a replacement at the sole cost of the seller. Replacement is subject to availability of stock with the seller.  Refund will be provided to the buyer only in cases where the product cannot be delivered/installed by the seller or cannot be replaced due to non-availability of stock.

  • All refunds will be processed post the reverse pick up of the product.

  • All packaging, reverse pick up, assembly/ disassembly shall be carried out by the seller and P Mart shall in no way be responsible for the same.

  • Seller shall be responsible for in transit damage and defective products.

     

1.4.    Returns under Precious Jewellery valued above INR 50,000/-

Notwithstanding anything to the contrary contained herein, following are the terms and conditions that shall govern the buyer returns for products falling under Precious jewellery valued above INR 50,000/-.

 

  • All products under this category will be eligible for returns (subject to P Mart’s prior approval) or replacement upto a period of 10 days from the date of receipt of the order. Notwithstanding anything to the contrary contained herein, coins shall not be eligible for return.

  • Click here to know the  eligible reasons for replacement or refunds in case of precious jewellery valued above INR 50,000/-

  • Buyer shall not be eligible for raising a replacement request on an already replaced item. In such cases, Buyer shall only be eligible for a refund.

  • Refund requests shall be processed subject to Seller’s discretion and in cases where the Seller does not agree for a refund, the item shall be replaced by the Seller.

     

2. Buyer Returns (RVP)

Buyer returns can be created by the buyer after the product is delivered successfully. Buyer returns can be one of the three types listed below depending on the case.

2.1. Buyer wants a replacement:

If the buyer has received an item in a 'Damaged' or 'Defective' condition or it is 'Not as Described' by the seller, he/she can request a replacement at no extra cost. Replacement is subject to availability of stock with the seller. If the product is out of stock, a refund will be provided to the buyer, no questions asked.

2.2. Buyer wants an exchange:

Under Return policy for fashion category products, buyers can request an ‘Exchange’ for the product in a different size or color. If the seller doesn’t have the required products in stock, a full refund will be provided to the buyer.

2.3. Buyer refund:

Under Return policy, a refund can be provided to a buyer if the buyer doesn’t want the product or if the requested replacement or exchange cannot be done due to product unavailability with the seller.

?3. Courier Returns (RTO)

Courier returns are returns which happen before the delivery of the product to the buyer. Following are the possible scenarios where RTO due to courier returns happen.

3.1. Buyer Not Reachable

  • If buyer is not reachable after 3 attempts by Logistics Partner’s attempt to deliver the package, customer support creates a RTO (return to origin) in the system of the Logistics Partner and the order would be considered cancelled. If buyers still want to purchase the item, he/she should place a new order. After receiving the trigger from Customer Support, the Logistics Partner will return the package to the seller. 

  • If Logistics Partner returns the package as an undeliverable package, a full refund will be automatically issued to the buyer.
     

3.2. Buyer Cancellation

  • Buyer may request to cancel the order and an order can be cancelled before it reaches the buyer. This creates an RTO in the system of the Logistics Partner and the Logistics Partner will return the package to the seller.

  • If you fail to ship the products within the prescribed time limit, buyer has a higher chance of cancelling the order.

  • Notwithstanding anything to the contrary contained herein, buyer cancellation for products falling under the Precious Jewellery valued above INR 50,000/- shall not be allowed once the shipment has been dispatched.

  • Notwithstanding anything to the contrary contained herein, buyer cancellation for products falling under Furniture and Sports & Fitness Category shall be allowed for free only in the following cases:

    1. Till 48 hours from the time the order is placed or shipment is dispatched, whichever is earlier.

    2.  2) In case of breach of delivery SLA by seller.

 4. Charges on Returns

Return created due to reasons including ‘damaged’, ‘manufacturing defects’, ‘size/colour exchange’ and ‘buyer ordered product by mistake’ cases would be addressed under this policy.  Under these scenarios:

  • Commission charged to you on sale will be reimbursed in case of refund.

  • Forward shipping fee will be waived for replacement/exchange.

 Commission and forward shipping charges will not be waived if the returns are the due to the fault of seller. This includes cases such as missing items, mis-shipment, item not as described, fake/expired products and used products. In these cases you’ll be charged for return shipping charges and commission will not be reimbursed.

5. Product Return Conditions

When is “Free Exchange Policy” applicable for buyers:

  • Clothing & Footwear - Free exchange(request for different size/color)

  • Sunglasses and Jewellery (Only Rings & Bangles) - Free exchange (Only size mismatch)

For following products returns will not be possible for buyers:

  • Categories like Innerwear, Lingerie, Socks  & Clothing freebies

  • Made to order/ custom jewellery

  • Any consumable item which has been used or installed

  • Items that are returned without original packaging, freebies or accessories

  • Products with tampered or missing serial numbers

  • Defective products which are covered under the manufacturer's warranty

  • Product damaged because of use

  • Product received is not in the same condition as seller shipped to the buyer

  • Return request is made outside the specified time frame

 

Following are few of the parameters specifying the item condition that should be complied with by the buyer for return:

6. Seller Protection Programme

Sellers are protected under the Seller Protection Programme against wrongful action of buyers in case of returns. After a return is received, seller can raise a claim for Seller Protection Fund via contacting P Mart Seller Support.

7. Guidelines to reduce returns

  • Ensure your product is genuine and saleable.

  • Ascertain brand/primary packaging is intact.

  • Avoid mis-shipping.

  • Ship the exact product as ordered.

  • Do not forget to include product components/freebie in the package.

  • Accept return requests to provide better buyer experience and improve seller ratings.


 

Fee Policy

P Mart collects the amount, including the item and shipping price, paid by a buyer for any transaction made. P Mart deducts as selling commission a percentage of the item price, shipping charges (which won’t apply for Furniture Category), plus a fixed per-item fee (herein after referred to as “Fee”). P Mart shipping rates apply to all items sold.

Advertising reward should be charged on the group basis & adversting depend upon membership discount (group 1,2,3) respectively..

For Example-

  1. If any product is in group 1 and membership discount is 10% on particular product, then advertising reward will be zero.

  2. If any product is in group 2 and membership discount is 10% on particular product, then advertising reward will be 50% ie 5% extra of membership discount.

  3. If any product is in group 3 and membership discount is 10% on particular product, then advertising reward will be 100% of membership discount.


 

Non Payment

P Mart reserves the right to issue a warning to you or temporarily/indefinitely suspend/ terminate your account on the Website and/or refuse to provide you with access to the Website in case of non-payment of fees/processing of refunds by you to P Mart. P Mart also reserves the right to take legal action in case of non-payment of fees/dues by you to P Mart.

Payment Surcharges

Sellers may not charge buyers an additional fee for their use of ordinary forms of payment, including electronic transfers or credit cards. Such costs should be built into the price of the item.  This policy reduces the potential for confusion among buyers about the true cost of an item. Further, some forms of payment surcharges, such as credit card surcharges, are prohibited by law or under the issuing institution's rules and regulations for merchants. However, sellers may charge buyers a reasonable shipping, installation (if applicable) and handling fees provided the payment of these fees by buyers is disclosed upfront in the listings. Shipping, installation (if applicable) and handling fee can cover a seller's reasonable costs for mailing, packaging, and handling the item. Shipping, installation (if applicable) and handling fees cannot be listed as a percentage of the final sale price.

P Mart shall raise an invoice on the seller on every 10th, 20th and 28th/30th/31st (last day of the month, as appropriate) towards Fee due and payable by the seller to P Mart. For all sales concluded by seller on the Website between 1st to 10th, invoice will be raised by P Mart on the 10th of the same month; for all transactions concluded between 11th to 20th, invoice would be raised by P Mart on 20th of the same month; and for all transactions concluded between 20th to 28th/30th/31st (last day of the month, as appropriate) invoice would be raised by P Mart on 28th/30th/31st (last day of the month, as appropriate). Essentially, P Mart will invoice the seller 3 (three) times in a month, i.e. 10th, 20th and 28th/30th/31st. Payments towards such invoices shall be deducted by P Mart from the seller remittances or if there is no monies to the credit of seller account, in such event, seller shall be liable to pay such Fee to P Mart within 7 days from the date of the invoice.

Parties expressly agree that any/all remittance/settlement related pay-outs shall be deemed to have been accepted by seller if seller does not furnish a written objection specifying the nature of the dispute within ninety (90) days from the date of transaction.

As an additional safety measure, sellers intending to register on the Website are required to provide verification documents.

Sellers whose transaction value has exceeded INR 50,000/- (cumulative) through transactions have to complete the additional verification (know your customer or KYC) process. Till the time such an additional verification is concluded, your remittances shall be on hold and only released upon completion of the KYC process. This verification procedure is aimed to further help Flipkart become a safer and secure e-commerce platform.

Seller needs to provide valid documents for proof of identity and address of the beneficiary or bank account holder mentioned during the registration process.

Important:  If a seller intends to update/change his/her bank account details, he/she should intimate Flipkart of such a change at least five business days before the effective date after change in bank account. For processing payments after duly completing the KYC process, you may be required to provide verification documents again for the new bank account to avoid payment rejections and delays in reprocessing of payments. As part of the KYC process, you are required to provide one valid document for proof of identity and one valid document for proof of address.
